What is Section 12?

Section 12 of the Public Order Act 1986 allows the Senior Police Officer at the scene to impose conditions on a public procession, “where he or she reasonably believes that the procession may result in serious public disorder, serious damage to property or serious disruption to the life of the community”.

Conditions can also be imposed where the Senior Police Officer reasonably believes that the purpose and intention of the people organizing the procession is to persuade others not to do something that they have a right to do, or vice versa. These conditions might include prohibiting the procession from entering a particular public place.

A public procession is defined by the Oxford Dictionary as: “A number of persons or vehicles moving forward in an orderly fashion; The action of moving in such a way; A relentless succession of people or things.”

It is a criminal offence to take part in a public procession and knowingly fail to comply with a condition.

However, it is a statutory defence to show that the failure to comply with the condition arose from a circumstance beyond your control. This offence carries a maximum penalty of a fine of £1000.
